General terms and conditions
These terms apply to every quote and order for rubber parts cut to size by RubberTailor.
Last updated: October 19, 2026
1. Scope
These terms apply to all quotes, order confirmations and deliveries of RubberTailor (KvK 94781494) to professional customers. Our services are intended for businesses; we do not sell to consumers. The customer's own purchasing terms apply only if we have accepted them in writing.
2. Online estimate, quote and order
The price shown by the online estimator is an indicative estimate based on the data entered; it is not an offer. We send a final quote on request. A quote is valid for the period stated on it, or 30 days if no period is stated. The contract is formed when we confirm the order in writing (by e-mail).
3. Prices and transport
Prices are in euros, excluding VAT. Transport, packaging and any delivery costs are not included in the online estimate: they are stated in the final quote sent to the customer. For deliveries to a business in another EU country with a valid VAT identification number, we apply the 0% rate (intra-Community supply); the customer provides this number and accounts for VAT in its own country. For deliveries outside the EU, import duties, VAT and other import charges in the country of destination are paid by the customer.
4. Drawings and data supplied by the customer
The customer is responsible for the accuracy of the drawings, dimensions, quantities and material chosen. DXF files are read at a scale of 1:1 in millimetres. Material advice is given to the best of our knowledge; the customer remains responsible for checking the suitability of the material for its own application.
5. Tolerances
Unless otherwise agreed in writing, the following dimensional tolerances apply:
- CNC-cut parts: ±0.5 mm;
- strips: ±2 mm.
Thickness, hardness and other material properties follow the tolerances of the raw sheet or roll. Rubber is flexible: dimensions are measured flat, at room temperature and without tension. Parts are cut straight (90°); bevels and V-cuts are not possible.
6. Delivery
Lead times are given as an indication. Exceeding them does not entitle the customer to compensation or to cancel the order, unless we have been given written notice and a reasonable additional period. Unless the quote states otherwise, the risk passes to the customer when the goods leave our premises.
7. Payment
Invoices are payable within the term stated on the invoice or, if no term is stated, within 30 days of the invoice date. We may ask for an advance payment, which is then stated in the quote. In the event of late payment, the statutory commercial interest (article 6:119a of the Dutch Civil Code) and the collection costs are due, with a minimum of €40.
8. Retention of title
Delivered goods remain the property of RubberTailor until the full price has been paid.
9. Inspection and complaints
The customer inspects the goods upon receipt. Visible defects must be reported in writing within 8 days of delivery, with photos, before the parts are used or processed. Hidden defects must be reported in the same way within 8 days of their discovery, and no later than 12 months after delivery. Parts are made to order and are therefore not taken back or exchanged, except after a justified complaint. For a justified complaint, we will, at our choice, cut the parts again or credit their price.
10. Liability
Our liability is limited to the invoice amount of the order concerned. We are not liable for indirect damage, such as loss of production, lost profit or consequential damage. These limitations do not apply in the event of intent or gross negligence on our part, or where the law does not allow them, such as statutory product liability.
11. Force majeure
Circumstances beyond our control (including machine breakdown, supplier failure, transport disruption, epidemic or extreme weather) suspend our obligations for as long as they last. If they last longer than 60 days, either party may cancel the order concerned without compensation.
12. Applicable law and disputes
Dutch law applies; the Vienna Sales Convention (CISG) is excluded. Disputes are submitted to the competent court of the district of Gelderland (the Netherlands). These terms are published in several languages; in the event of a discrepancy, the Dutch version prevails.
